However, this refund is only eligible if the client follows our process, is responsive, cooperative and provides the necessary information on time to schedule the booking. Additionally, this guarantee is not effective due to a client’s change of mind or otherwise.

TV INTERVIEW AND/OR MEDIA AGREEMENT

This Agreement is between (Client) and TV Interview Masters (Agency).

This Agreement serves as legitimate and legal documentation to the services being purchased by Client and provided by TV Interview Masters. Services will not be provided until the transaction is verified, the invoice paid, and this Agreement has been signed concurrently by the client. Upon purchase, the Agency will undertake the strategy process immediately, arranging interviews with the Client and the journalist(s) and/or contributor(s) of the proposed network as discussed with the Client. The Client or a designated representative of the Client will be responsible for communicating with the Agency and its team throughout the process spanning from the beginning to the finalization of the process.

By accepting this Agreement, you hereby acknowledge, understand and agree to the following terms of Agreements:

Services. The Client can expect a TV interview remotely/virtually (via zoom or other video software), on a show on a recognizable network.

The investment for this service is $

Payment. FULL PAYMENT is due upon receipt of invoice. All transactions are finalized and/or approved by TV Interview Masters prior to any services being provided. If the Client is an LLC, Corporation, LLP, or other entity, then the individuals signing this Agreement hereby agree to, jointly and severally as applicable, personally guarantee the payment and collection of all fees and costs payable under this Agreement, on behalf of said entity.
Refund Policy. All transactions and sales are final, and no refunds or cancelations will be provided. Additionally, you waive any rights to charge-back your purchase with your credit processor. You will be entitled to a refund in accordance with our money back guarantee ONLY if TV Interview Masters fails to provide the TV interview, booked and scheduled. REFUNDS WILL NOT BE PROVIDED DUE TO A CLIENT’S CHANGE OF MIND OR OTHERWISE.
Disclaimer. This is a marketing/public relations service. TV Interview Masters cannot and does not promise or guarantee any level of earnings or specific results from this service. Levels of success vary and cannot be replicated as a ‘One Size Fits All’ as these results are dependent on the individual, their product, and other important factors. It is the responsibility of the Client to use this service however they wish to promote themselves, their business or service. Due to availability, scheduling, and newsworthiness, you understand that the scheduled show, network, date and/or time, may be changed from the initially scheduled network, show, date and/or time, which may have been initially promoted or advertised. TV Interview Masters reserves all rights to schedule the TV interview with the show, network, based on the client needs, availability of inventory and budget. TV Interview Masters reserves the right to make changes without notice. However, we will do our best to notify you if any such changes are necessary. If a change to a scheduled interview is necessary, the deliverable has been fulfilled to the client and the refund policy is not valid.
Law & Jurisdiction. This Agreement shall be interpreted and governed according to the laws of the State of MARYLAND and the laws of the United States of America without regard to or application of its conflict of law, rules or principles. Both parties agree that any disputes shall be governed by the laws of the State of MARYLAND and the Federal Government. Both parties acknowledge that they have the right to dispute a conflict between the two parties either Client to TV Interview Masters, vice-versa, or mutual dispute involving services, payment, fraud and/or other. Both the Client and TV Interview Masters are entitled to pursue legal action in a Court of Law located within the State of MARYLAND. Either party may demand that any dispute between the two parties involving services, payment, fraud and/or other must be settled by binding arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in MARYLAND, USA. Should one seek legal counsel, that shall not prevent TV Interview Masters and its affiliates from seeking injunctive relief in a court of competent jurisdiction. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.
Force Majeure. If either party is prevented from performing any of its obligations under this agreement due to any cause beyond the party's reasonable control, including, without limitation, a fire, flood, explosion, war, strike, embargo, government regulation, civil or military authority, acts or omissions of carriers, transmitters, providers, vandals, or hackers (a "force majeure event") the time for that party's performance will be extended for the period of the delay or inability to perform due to such occurrence; provided, however, that you will not be excused from the payment of any sums of money owed by you to TV Interview Masters; and provided further, however, that if a party suffering a force majeure event is unable to cure that event within thirty (30) days, the other party may terminate this agreement.
Indemnity. You agree to indemnify and hold TV Interview Masters, its subsidiaries and affiliates, and their officers, agents, attorneys and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by you or any third party due to or arising out of: this agreement, your services with TV Interview Masters, a breach of this agreement, any breach of your representations and warranties set forth will lead to termination of services without refund.
Miscellaneous. This agreement represents the entire agreement between you and TV Interview Masters related to the Public Relations and Media, and prevails over any prior or contemporaneous, conflicting, or additional communications, whether written or oral with respect to the subject matter. This Agreement shall be binding upon and shall insure to the benefit of the respective parties hereto, their respective successors-in-interest, licensees, sub licensees, legal representatives, heirs and assigns. No failure of either party to exercise or enforce any provision or any of its rights under this Agreement shall act as a waiver of that provision, of any provision in this Agreement or of subsequent breaches; and the waiver of any breach shall not act as a waiver of subsequent breaches. In the event that any provision of this Agreement is held by a court of other tribunal of competent jurisdiction to be unenforceable, that provision shall remain in full force and effect and will be enforced to the maximum extent permissible under applicable law, and the other provisions of this Agreement will remain in full force and effect. The parties further agree that in the event such a provision is an essential part of this Agreement, they begin negotiations for a suitable replacement provision. Your failure to use the Services after purchase does not void any part of this Agreement. You may not, without the prior written consent of TV Interview Masters, assign this Agreement, in whole or in part, either voluntarily or by operation of law, and any attempt to do so shall be a material default of this agreement and shall be void. TV Interview Masters reserves rights and obligations, in whole or in part, under this Agreement may be assigned or transferred by TV Interview Masters. Due to the nature of media, and public relations, there are factors that are out of the reach of TV Interview Masters and its affiliates, thus cannot be held liable in any or all circumstances. Factors as such include but are not limited to views of the shows or articles, who the contributors are, intended outcomes from press, etc. In addition, TV Interview Masters will not be liable for results that may or may not come after the services have been provided as the service is intended for one time use and is not to be confused with subscriptions, memberships, and/or any other exclusive material. As independent contractors, TV Interview Masters Representatives will not be required to report to work at any particular time, work any particular schedule each day, or be required to work any particular number of hours each day unless dictated by the demands of a particular project on which an TV Interview Masters Representative is working. Nothing contained in this Agreement shall be construed to (i) give either party the power to direct and control the day-to-day activities of the other; (ii) deem the parties to be acting as partners, joint ventures, co-owners or otherwise as participants in a joint undertaking; or (iii) allow either party to create or assume any obligation on behalf of the other party for any purpose whatsoever. Except as provided herein, the rights and remedies of TV Interview Masters are set forth in this Agreement are not exclusive and are in addition to any other rights and remedies available to it at law or in equity. This agreement is solely for the benefit of the parties and their successors and permitted assigns and does not confer any rights or remedies on any other person or entity. This Agreement shall be construed and interpreted fairly, in accordance with the plain meaning of its terms, and there shall be no presumption or inference against the party drafting this Agreement in construing or interpreting the provisions hereof. Your signature below indicates acceptance of this proposal. Your payment per the terms above will also represent acceptance of this proposal, and entrance into a contractual Agreement with TV Interview Masters.
